Throughout these Terms, “we”, “us” and “our” refer to MODEVIBE LIMITED.
By accessing the website, using our services or placing an order, you agree to these Terms of Service.
1. Eligibility
You must have the legal capacity to enter into a binding contract to place an order.
Products intended for children must be purchased by an adult. Adults are responsible for reviewing product descriptions, age recommendations, warnings and supervision requirements before allowing a child to use a product.
2. Product Information
We aim to present product descriptions, images, prices and availability accurately. Colours and appearance may vary depending on lighting, packaging updates and screen settings.
Customers must review product dimensions, age recommendations, included components and safety information before ordering.
We may correct genuine typographical, pricing or product-information errors. If an error materially affects an order, we will contact the customer and provide an appropriate option, including cancellation and a refund where necessary.
3. Orders
Submitting an order is an offer to purchase the selected products. An automated order acknowledgement does not necessarily constitute final acceptance.
We may decline or cancel an order where reasonably necessary, including when:
- payment cannot be authorised;
- a product is unavailable;
- order or customer information appears incorrect;
- we identify a pricing or listing error;
- fraud or unauthorised activity is reasonably suspected; or
- fulfilling the order would violate applicable law.
If we cancel an order after receiving payment, we will refund the affected amount to the original payment method.

5. Shipping
Our processing time is generally 1–3 business days, followed by an estimated delivery time of 2–5 business days within Australia.
Shipping timeframes are estimates and may be affected by events outside our reasonable control.

6. Returns and Refunds
Eligible change-of-mind returns may be requested within 30 days after delivery, subject to our Return and Refund Policy.
Nothing in these Terms or our Return and Refund Policy excludes, restricts or modifies rights that cannot legally be excluded, including applicable rights under the Australian Consumer Law.
7. Product Safety
Customers must follow all instructions, warnings, age recommendations and safety information supplied with a product.
Adult assembly or supervision may be required for certain toys. Packaging materials and small components should be kept away from children where they create a choking or other safety risk.

You must not:
- use the website for unlawful, fraudulent or abusive purposes;

If you do not recognise a transaction or believe there is a problem with an order, contact info@playswap.com promptly so that we can investigate.
We may request relevant information reasonably required to investigate the transaction, delivery or payment.
This section does not prevent a customer from exercising lawful rights through a bank, card issuer, payment provider or consumer-protection authority.

These Terms are governed by the laws of Hong Kong, without excluding any mandatory consumer protections that apply in the customer’s place of residence.
For customers in Australia, nothing in this governing-law clause limits rights or remedies available under applicable Australian law.
